After a wait of almost ten years, the Lusaka High Court provided the final hearing for the Zambezi Portland Case and gave a new direction to the court proceedings to finish the case soon. This indeed is a good news for Dr. Mahtani and team. However, the Ventriglias who launched a counterclaim is not very happy with the announcement. Once Dr. Rajan Mahtani wins this case, the Ventriglias will have to give up Zambezi Portland Cement, which is under their capture for the past nine years.
During the course of the case hearing, Dr. Rajan Mahtani and his company have submitted various evidence and statements to support their claim. Some of these included signed shareholder agreement, by all parties including the Ventriglias. This agreement clearly states that Dr. Mahtani holds 58 percent shares at the factory, making him the majority shareholder. Various financial exhibits further claim that Dr. Mahtani and his companies have invested over USD 8 million dollars for the growth and development of the factory. Another important document submitted was the audit report conducted by an independent auditor on the factory. As per this audit report, Dr. Mahtani is the sole joint venture partner of the establishment which was started as a joint-venture project.
It is surprising to see that even after such strong evidence from Dr. Mahtani’s team and no strong evidence from the Ventriglias; the court has not been able to provide any final judgment. Things are expected to turn when evidence from both sides will be submitted
