The Ventriglia family recently approached the Supreme Court Zambia challenging the decision from the higher Court of Appeal on the Portland Cement Zambia case. To evaluate this case, a bench of three Supreme Court judges was established. After evaluation, the Supreme Court judges effectively rejected this claim.
The claim was dismissed dependent on two significant grounds. The primary ground was law as per law, any case against previous court decision should be settled on inside fourteen days of the choice from the first court. In the current case, the decision was given by the higher Court of Appeal on 31st January 2019. In view of this date, the Ventriglias ought to have made the allure within 15th February 2019. Nonetheless, the Ventriglias moved toward the court extremely late which is just about a long time since an official choice by higher Court of Appeal on Zambezi Portland Cement manufacturing plant. Based on legitimate grounds alone, the case gets invalid. The second ground on which this allure from the Ventriglias was dismissed was identified with the conditions related with the case. As per the appointed authorities, the Supreme Court of Zambia doesn't have any jurisdiction endeavoring this case as the conditions encompassing the allure is indistinct. In their assertion, the seat of Supreme Court Judges demonstrated that regardless of whether the Supreme Court of Zambia acknowledges the case, a ultimate conclusion will align with the choice from higher Court of Appeal dependent on the confirmations and tributes. Accordingly, the Supreme Court of Zambia viably dismissed the claim made by the Ventriglias. As such, Dr. Rajan Mahtani stays the larger part investor and legitimate proprietor of the Portland Cement Zambia plant.
